By using this Site, you acknowledge and agree to these terms of use. Tent Motel reserves the right, at Tent Motel's discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms at regular intervals for any changes. Your continued use of the Site following any change to these terms will be deemed acceptance of those changes.

USE OF MATERIALS

Personal Use
Tent Motel authorises you to print, copy, re-produce, download and view materials on the Site, subject to:

• the material being used exclusively for personal use;
• the material not being modified in any manner; and
• the material must display the following legal copyright notice:

You expressly acknowledge that you must not reproduce, copy, or re-design the Tent Motel logo.

In the event you download material (including software) from the Site, the software, including any files, and/or images incorporated in or generated by the Software, and data accompanying the software (collectively, the "Software") are licensed to you by Tent Motel. You are expressly prohibited from selling, distributing, decompiling, reverse engineering or otherwise dealing with the Software in a like manner.

Commercial use
Copying, reproduction or distribution of material from the Site for any commercial use is expressly prohibited without Tent Motel 's express written consent.

BULLETIN BOARDS, CHAT ROOMS AND OTHER ON-LINE COMMUNICATION FORUMS

You are expressly prohibited from uploading to, distributing through, or otherwise publish through the Site any inappropriate communication in any form (including, but not limited to text, images, video and/or sound). Inappropriate communications include obscene, harassing, pornographic, abusive, slanderous, defamatory, vulgar, threatening and/or offensive material.

Commercial use of bulletin boards, chat rooms and other on-line communication forums is strictly prohibited without Tent Motel's express written consent.

PRIVACY

Tent Motel will not observe, edit, or disclose the contents of any information provided to the Site by you, unless required:

• to do so by law, or in good-faith believe that such action is necessary to comply with the law; or
• to protect the interests of other Site users; or
• to protect Tent Motel's interests.

You are expressly liable for the content of any communication (including but not limited to data, images, video, text and/or sound) which you upload to the Site. By uploading materials to the Site, you grant Tent Motel a non-exclusive, royalty free, perpetual licence to use, modify, reproduce, distribute or otherwise deal with the uploaded material in any manner which Tent Motel deems appropriate. In addition, you agree to waive all "moral rights" in those materials.

INFORMATION AT THE SITE

Tent Motel updates the Site regularly, however Tent Motel makes no representation as to the accuracy, currency or completeness of any information at the Site. You should not rely on any of the information or services provide at the Site. All information and services at the Site are provided on an "as is" basis, without warranty express or implied and that you use the information and/or services at your own risk.

LINKS TO OTHER SITES

One of the services which the Site provides is access to other sites on the internet via hyperlinks located on the Site ("Linked Sites"). While Tent Motel has used reasonable endeavours to review the Linked Sites, Tent Motel is not responsible for the accuracy, legality, decency of material or copyright compliance of Linked Sites.

DISCLAIMER

The materials in this Site are provided "as is" and without warranties of any kind either express or implied to the fullest extent permissible pursuant to applicable law, Tent Motel disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

Tent Motel makes no claim as to the accuracy of the content contained in the Site. Tent Motel does not accept liability to any person for the information or advice provided on the Site or incorporated into it by reference. Tent Motel does not accept any liability for loss or damages incurred by any person as a result of reliance placed upon the content of the Site or any other information incorporated by reference.

Tent Motel makes no representation as to the accuracy or any other aspect of the information contained on servers linked to the Site via hyperlinks from the Site.

This information is provided on the basis that all persons accessing the Website undertake the responsibility for assessing the accuracy of its content and that they rely on it entirely at their own risk.

INDEMNIFICATION

You are entirely responsible for maintaining the confidentiality of your password and account, if issued. You are entirely responsible for any and all activities which occur under your account and agree to indemnify, defend, and hold harmless Tent Motel for any liability or expense arising from such use or misuse. You agree to immediately notify Tent Motel of any unauthorised use of your account.

JURISDICTION

This agreement is construed according to and is governed by the laws of New South Wales, Australia . The parties submit to the exclusive jurisdiction of the courts in and of New South Wales in relation to any dispute arising under this agreement.

TERMINATION

This agreement is effective from your first use of the Site until terminated by either party.

You may terminate this agreement at any time by unsubscribing to all services provided by the Site and destroying all materials obtained from the Site, all related documentation and all copies and installations thereof, whether made under the terms of this agreement.

This agreement will terminate immediately without notice from Tent Motel, if in Tent Motel's sole discretion, you fail to comply with any term or provision of these terms. Upon termination, you must destroy all materials obtained from the Site and unsubscribe to all services provided by the Site.

Tent Motel Online Purchases

TENT BOOKINGS : Payment is required at the time of booking. Customers will receive an email receipt of the transaction as proof of payment. No further receipt will be issued.

APPLICABLE LAW :  Transactions between Tent Motel and its customers shall be governed by and construed according to the law of New South Wales, Australia.

ONLINE SECURITY : Tent Motel uses SecurePay's Internet Payment Gateway to provide a secure environment for the authorisation of credit card transactions over the Internet. Confidential information including client credit card details are encrypted the moment they are transmitted from the client's browser to the banking network using industry standard SSL 128-bit RC4 encryption technology.

A client's credit card details are not stored anywhere on the Internet and the only company who has access to this data is the merchant's bank. The bank also sends confirmation information via the same encryption technology back to the client's browser. These secure processes provide clients with peace of mind when purchasing online.

Returns Policy

• no proof of purchase is offered
• customers simply change their mind
• the goods have been damaged after purchase or
• customers knew, or should have known about any faults when they bought the goods.

With some exceptions, Tent Motel accepts the return of items only if:

• they are in their original condition with their original packaging
• you notify us of the problem within 48 hours of receipt by you and obtain a Return Authorisation, and 
• despatch them to us within seven days of receipt. 

We do not accept COD returns.  If you ordered the incorrect product (eg. wrong size) acceptance of return is at Tent Motel's discretion.

Any refund we provide will be made using the same payment method as you used to purchase the goods (eg. credit your credit card if you purchased the goods using a credit card).

Postage and handling charges are not refundable.  Returns may attract a 15% handling fee.

NON-RETURNABLE ITEMS: Certain items in our range are non-returnable.  DVDs, which can be consumed by being read or viewed, are non-returnable unless they are defective (unable to be read, etc).  Clothing that has been worn or washed may not be returned unless it can be shown to be defective.

DEFECTIVE GOODS: If goods are found to be defective in materials or workmanship, they may be returned to Tent Motel within 30 days of purchase.  However items that have been sold at a reduced price because of their defects may not be returned.  You must include with returned goods a Return Authorisation with a full description of the defect(s), along with your proof of purchase.  Defective items may be repaired, replaced or refunded, at Tent Motel's discretion.  Returns of defective items do not attract a handling fee.

Please note: The only situation in which we accept returns of goods that are not in as-new condition and with their original packaging is if they are demonstrably defective.

SALE ITEMS: Goods that have been purchased as part of a clearance sale may not be returned or exchanged.

This returns policy does not seek to limit your statutory rights.
